Practo Technologies Private Limited (“us”, “we”, or “Practo,” which also includes its affiliates) is the author and publisher of the internet resource www.practo.com (“Website”) on the world wide web as well as the software, services and applications provided by Practo, including but not limited to the mobile application ‘Practo’ (together with the Website, referred to as the “Services”). It has further licensed the Website and the mobile application to Practo Inc. in the United States of America (‘USA’) region.

This privacy policy (“Privacy Policy“) explains how we collect, use, share, disclose and protect Personal Data for residents and Users in the United States.  We created this Privacy Policy to demonstrate our commitment to the protection of your privacy and your Personal Data. The purposes for which we collect your Personal Data, and the ways in which we process it, may vary depending on our relationship with you.  For the purposes of this Privacy Policy, the following definitions shall apply:

  • We will refer to a medical practitioner or health care provider (whether an individual professional or an organization) or similar institution wishing to be listed, or already listed, on the Website, including designated, authorized associates of such practitioners or institutions as “Practitioner(s)”, “you” or “User”
  • We will refer to a patient, his/her representatives or affiliates, searching for Practitioners through the Website as “End-User”, “you” or “User”
  • We will refer to all other users of or visitors to the Website as “you” or “User”

Any other capitalized term used but not defined in this Privacy Policy shall have the meaning attributed to it in our Terms of Use.  Your use of and access to the Services is subject to this Privacy Policy and our Terms of Use.  By using the Services, or by otherwise giving us your Personal Data or other information, you acknowledge that you have read, understood, and agree to be bound by the practices and terms outlined in this Privacy Policy and the Terms of Use.  If you do not agree with this Privacy Policy or the Terms of Use at any time, you should not use the Services or give us any of your Personal Data or other information.

 

1. COLLECTION AND USE OF PERSONAL DATA

      1. All the information provided to Practo by a User is voluntary. You understand that Practo may use certain information of yours, which has been designated as Personal Data (a) for the purpose of providing you the Services, (b) for commercial purposes and in an aggregated or non-personally identifiable form for research, statistical analysis and business intelligence purposes, (c) for communication purpose so as to provide You a better way of booking appointments and for obtaining feedback in relation to the Practitioners and their practice, (d) debugging customer support related issues, (e) for the purpose of contacting you to complete any transaction if you do not complete a transaction after having provided us with your contact information in the course of completing such steps that are designed for completion of the transaction.
      2. You are responsible for maintaining the accuracy of the information you submit to us, such as your contact information provided as part of account registration. If your Personal Data changes, you may correct, delete inaccuracies, or amend information by making the change on our member information page or by contacting us through Support@practo.com. We will make good faith efforts to make requested changes in our then active databases as soon as reasonably practicable. 
    • Cookies and Universal Opt-Out Mechanisms
      1. Due to the communications standards on the Internet, when anyone visits the Website, Practo automatically receives the URL of the site from which anyone visits. Practo also receives the Internet Protocol (IP) address of each User’s computer (or the proxy server a User used to access the World Wide Web), the User’s computer operating system and type of web browser the User is using, email patterns, and the name of User’s Internet Service Provider (ISP). This information is used to analyze overall trends to help Practo improve its Services. 
      2. The Website uses temporary cookies to store certain information that is used by Practo and its service providers for the technical administration of the Website, research and development, and for User administration. “Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier. 
      3. In the course of serving advertisements or optimizing services to its Users, Practo may allow authorized third parties to place or recognize a unique cookie or similar online tracker on the User’s browser. These cookies are used by our advertising partners to serve advertisements to you.  If you do not wish to share Personal Data through cookies and other online trackers, you may adjust your internet browser to disable cookies.       4. You may also choose to install Universal Opt-out Mechanisms (UOOMs) on your browser.     • Unregistered Users
      1. A User may have limited access to the Website without creating an account on the Website. Unregistered Users can make appointments with the doctors by providing their name and phone number, as described above. In order to have access to all the features and benefits on our Website, a User must first create an account on our Website. To create an account, a User is required to provide the following information: name and contact number. Practo uses this information to allow Practo and other individuals, such as medical providers, to contact you.  Other information requested on the registration page, including the ability to receive promotional offers from Practo, is optional.
      2. If you wish to opt-out of receiving non-essential communications such as promotional and marketing-related information regarding the Services, please send us an email at support@practo.com. 

     1.2 Personal Data Collected from Registered End-Users

    1. As part of the registration/application creation and submission process that is available to End-Users on this Website, certain information, including Personal Data is collected from the End-Users.  This Personal Data may include: Name; Contact Number; Email ID; Gender; Date of Birth; Emergency Contact; General Location; and Payment Information (though a third-party payment processor).  
    2. All of this information is provided by you, voluntarily.  Only your name and contact number are required to register an account.
    3. While you use the services, we may also collect data regarding your usage of the services and history of the appointments made by or with you through the use of Services.
    4. We use this information for the purpose of providing you the Services, improving the Services, to provide advertisements to you directly through our own marketing or through our third-party advertising partners, or as otherwise described below.  
    5. Practo may also use information provided by or about the End-User for the following purposes:
      1. Identifying You.
      2. Publishing such information on the Website in relation to content posted by you on the Website
      3. Contacting End-Users for offering new products or services.
      4. Contacting End-Users for taking product and Service feedback.
      5. Analyzing software usage patterns for improving product design and utility or for research and development of new technologies.
      6. Analyzing anonymized practice information for commercial use.
      7. Processing payment instructions including those through independent third-party service providers such as payment gateways, banking and financial institutions, pre-paid instrument and wallet providers for processing of payment transaction or deferral of payment facilities.
  1. End-Users’ Personal Data, which they choose to provide on the Website is used to help the End-Users describe/identify themselves. Other information collected through the Website is collected by Practo from End-Users (such as patterns of utilization described above). Practo may also use such information in an aggregated form for research, statistical analysis and business intelligence purposes. In particular, Practo reserves the right to use End-User demographics information for the following purposes:
    1. Analyzing software usage patterns for improving product design and utility.
    2. Analyzing such information 
    3. Using analysis of such information in other commercial product offerings of Practo.
    4. Sharing analysis of such information with third parties for commercial use.

Practo will communicate with the End-Users through email, phone and notices posted on the Website or through other means available through the service, including text and other forms of messaging. The End-Users can change their e-mail and contact preferences at any time by logging into their “Account” at www.practo.com and changing the account settings.

By agreeing to communicate with us by text message, you agree to receive text or mobile messages related to our Services and activities, subject to our Terms of Use.  These messages may include, but are not limited to: information about your appointments or otherwise related to our Services.  We will not share your opt-in to a text or mobile messaging campaign with any third party for purposes unrelated to our Services and activities. We may share your Personal Data, including your text or mobile message opt-in or consent status, with third parties that help us provide our text or mobile messaging services, including but not limited to platform providers, phone companies, and any other vendors who assist us in the delivery of text or mobile messages.  Messaging frequency may vary depending on the nature of your communication with us or your use of our Services. Message and data rates may apply based on your mobile carrier’s plan. You may opt out of receiving text or mobile notifications at any time by texting STOP.   4. At times, Practo conducts a User survey to collect information about End-Users’ preferences. These surveys are optional and if End-Users choose to respond, their responses will be kept anonymous. Similarly, Practo may offer contests to qualifying End-Users in which we ask for contact information such as name, email address and mailing address. The information that Practo collects in the registration process and through surveys is used to help Practo improve its Services to meet the needs and preferences of End-Users.
  5. Practo may keep records of electronic communications and telephone calls received and made for making appointments or other purposes for the purpose of administration of Services, customer support, research and development and for better listing of Practitioners.
  6. If you wish to cancel your account or request that we no longer use your information to provide you Services, please contact us through support@practo.com

1.3 Personal Data Collected from Practitioners

    1. As part of the registration as well as the application creation and submission process that is available to Practitioners on Practo, certain information, including Personal Data is collected from the Practitioners.  This Personal Data may include: Name; Gender; City; Primary Contact No.; Primary Email ID; Practicing Start Year; Experience Years; Languages; Title; Photo URL; Subspecializations; Qualifications Degree; Qualifications Institute; Qualifications Year; Registration Year; and Registration Council Name.  
    2. Practo may also collect the following from clinics or hospitals: Name; Address; Latitude; Longitude; Locality; City; Contact No.; Email ID; Practice Type; Services; Speciality; and Timings.
    3. We use this information for the purpose of providing the Services, improving the Services, to provide advertisements regarding the Servics through our own marketing or through our third-party advertising partners, or as otherwise described below
    4. The Practitioner information listed on Website is displayed when End-Users search for doctors on the Website, and the Practitioner information listed on Website is used by End-Users to request for doctor appointments. Any Personal Data of the Practitioners listed on the Website is provided to Practo by Practitioners who wish to enlist themselves on the Website, or is collected by Practo from the public domain. Practo displays such information on its Website on an as-is basis making no representation or warranty on the accuracy or completeness of the information. As such, we strongly encourage Practitioners to check the accuracy and completeness of their information from time to time, and inform us immediately of any discrepancies, changes or updates to such information. Practo will, however, take reasonable steps to ensure the accuracy and completeness of this information.
    5. Practo may also display information for Practitioners who have not signed up or registered for the Services, provided that the information is obtained from official sources in the public domain. Such Practitioners are verified by Practo or its associates, and Practo makes every effort to capture accurate information for such Practitioners. However, Practo does not undertake any liability for any incorrect or incomplete information appearing on the Website for such Practitioners. 
    6. Practo may use such information for commercial purposes and in an aggregated or non-personally identifiable form for research, statistical analysis and business intelligence purposes. Practo also may use information provided by or about the Practitioner for the following purposes:
      1. Publishing such information on the Website.
      2. Contacting Practitioners for offering new products or services.
      3. Contacting Practitioners for taking product feedback.
      4. Analyzing software usage patterns for improving product design and utility.
      5. Analyzing anonymized practice information including financial, and inventory information for commercial use.
    7. As a Practitioner, you may avail yourself of the listing service without registering for an account by providing information such as your name, contact number, email address, and such other information as requested by any of Practo’s employees or agents who contact you in person or by telephone. In such an event, Practo will maintain this information if and until you choose to register for an account, for which Practo may contact you from time to time. Practo will, after such information is collected from you, send you a confirmation email confirming the information provided and the fact that you will be listed on the Website. In the event you do not wish to be so listed on the Website, please inform Practo immediately at support@practo.com

2. SHARING PERSONAL DATA

    1. To the extent necessary to provide End-Users with the Services, Practo may provide their Personal Data to third parties as follows: 
      1. Affiliated group companies who provide IT and system administration, data processing, product and business development and back-office services.
      2. Healthcare Providers/Clinics with whom End-Users have booked appointments through our Website.
      3. Service providers who provide IT, system administration and payment processing services.
      4. Professional advisers including lawyers, bankers, auditors, and insurers who provide consultancy, banking, legal, insurance and accounting services.
      5. Third parties as part of a reorganization or a sale of the assets of a Practo corporation division or company. 
    2. We require all third parties to respect the security of your Personal Data and to treat it in accordance with the applicable laws and regulations. We do not allow any of the above third parties to use your Personal Data for their own purposes and only permit them to process your Personal Data in accordance with our specific instructions.
    3. We also share Personal Data collected through our Website with our advertising partners to serve advertisements to you or otherwise market products that you may find of interest.  Please see the section above titled “Cookies and Universal Opt-Out Mechanisms” for more information on how we may share your Personal Data through the use of cookies and other online trackers.
    4. Practo takes your right to privacy very seriously and other than as specifically stated in this Privacy Policy, will only disclose your Personal Data in the event it is required to do so by law, rule, regulation, law enforcement agency, governmental official, legal authority or similar requirements or when Practo, in its sole discretion, deems it necessary in order to protect its rights or the rights of others, to prevent harm to persons or property, to fight fraud and credit risk, or to enforce or apply the Terms of Use.

3. PROTECTING PERSONAL DATA

    1. Practo has implemented best international market practices and security policies, rules and technical measures to protect the Personal Data that it has under its control from unauthorized access, improper use or disclosure, unauthorized modification and unlawful destruction or accidental loss. However, no data transmission can be 100% safe.  We cannot guarantee or warrant the security of any information disclosed or transmitted to us and cannot be responsible for the theft, destruction or inadvertent disclosure of Personal Data.  For any data loss or theft due to unauthorized access to the User’s electronic devices through which the User accesses the Services, Practo shall not be held liable for any loss whatsoever incurred by the User.

4. RETAINING AND DELETING PERSONAL DATA

    1. We will retain your information as long as your account with the Services is active and as needed to provide you the Services or as required under applicable laws and regulations. We shall not retain such information for longer than is required for the purposes for which the information may lawfully be used or is otherwise required under any other law for the time being in force. After a period of time, your data may be anonymized and aggregated, and then may be held by us as long as necessary for us to provide our Services effectively, but our use of the anonymized data will be solely for analytic purposes. Please note that your withdrawal of consent, or cancellation of account may result in Practo being unable to provide you with its Services or terminating any existing relationship Practo may have with you. 

5. INTERNATIONAL DATA TRANSFERS

  • By using Practo, you acknowledge and provide your express written consent to the processing, transfer and storage of your Personal Data outside the United States of America by and to our affiliated group companies. Practo implements reasonable security practices and procedures and has a comprehensive documented information security program and information security policies that contain managerial, technical, operational and physical security control measures that are commensurate with respect to the information being collected and the nature of Practo’s business. Where we transfer your Personal Data as stated above to third parties, we aim to ensure a similar degree of protection is afforded to the Personal Data by such third parties through the use of strict contractual obligations.


6. THE CONTENT OF THE SERVICES AND LINKS TO THIRD-PARTY SITES

    1. Practo does not control or endorse the content, messages or information found in any Services and, therefore, Practo specifically disclaims any liability with regard to the Services and any actions resulting from your participation in any Services, and you agree that you waive any claims against Practo relating to same, and to the extent such waiver may be ineffective, you agree to release any claims against Practo relating to the same.
    2. Practo does not exercise control over the sites displayed as search results or links from within its Services. These other sites may place their own cookies or other files on the Users’ computer, collect data or solicit personal information from the Users, for which Practo is not responsible or liable. Accordingly, Practo does not make any representations concerning the privacy practices or policies of such third parties or terms of use of such websites, nor does Practo guarantee the accuracy, integrity, or quality of the information, data, text, software, sound, photographs, graphics, videos, messages or other materials available on such websites. The inclusion or exclusion does not imply any endorsement by Practo of the website, the website’s provider, or the information on the website. If you decide to visit a third party website linked to the Website, you do this entirely at your own risk. Practo encourages the User to read the privacy policies of that website.
    3. The Website may enable Users to communicate with other Users or to post information to be accessed by others, whereupon other Users may collect such data. Such Users, including any moderators or administrators, are not authorized Practo representatives or agents, and their opinions or statements do not necessarily reflect those of Practo, and they are not authorized to bind Practo to any contract. Practo hereby expressly disclaims any liability for any reliance or misuse of such information that is made available by Users or visitors in such a manner.

 

7. CHILDREN’S PRIVACY

    1. The Services and the Website are not intended for children under 18 years old.  We do not knowingly collect Personal Data from anyone under 18 years of age. If you are under age 18, please do not use the Services or submit any Personal Data to us.
    2. Practo strongly encourages parents and guardians to supervise the online activities of their minor children and consider using parental control tools available from online services and software manufacturers to help provide a child-friendly online environment. These tools also can prevent minors from disclosing their name, address, and other Personal Data online without parental permission.

8. PRIVACY RIGHTS FOR RESIDENTS OF CERTAIN STATES

    1. If you are a resident of California, Colorado, Connecticut, Delaware, Iowa, Montana, Minnesota, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah or Virginia, you may have certain rights regarding the use of your Personal Data. 9. EXERCISING YOUR STATE PRIVACY RIGHTS

We will use this information only for the purposes of verifying that your request is authentic.
      2. Once we receive your request, we will respond within 10 business days and inform you if we need any more information in order to verify your request. We will provide the information you requested within 45 days of your request. If we require more than 45 days to respond to your request, we will inform you of the reasons why.
